Terms of service

1. The agreement

These terms are between SMPL and the business that signs up ("you"). By creating an account or using SMPL, you agree to them on behalf of your business, and confirm you are allowed to.

2. The service

SMPL provides a CRM for contracting businesses, a branded app for your team, Jackie (an AI website assistant) and related tools. We may improve and change features over time. If we remove a major feature you pay for, we will tell you in advance.

3. Plans, billing and cancelling

• Plans are priced by the number of people using SMPL, as shown on our pricing page, in US dollars, plus applicable taxes.
• Plans are month to month unless you choose yearly billing. You can cancel at any time; your plan runs to the end of the period you have paid for. We do not refund partial months.
• If your team grows past your plan, your plan moves up to match. We will tell you before your price changes.
• Jackie is free for the first 3 months on every plan, then billed at the price shown unless you turn it off.
• Usage-based extras (for example text messages above your plan’s allowance) are billed as described when you turn them on.
• If a payment fails, we will let you know and may pause the account after 14 days.

4. Your data

You own the information you and your team put into SMPL, including your customers’ information. You give us permission to store and process it only to provide and support the service. When you cancel, we will give you an export on request and then delete it as described in our privacy policy.

You are responsible for having the right to collect the information you put into SMPL and for getting any consent your customers need, including consent to receive emails and text messages from you.

5. Acceptable use

• Don’t use SMPL to send spam or messages people haven’t agreed to receive.
• Don’t break the law, or upload anything you don’t have the right to.
• Don’t try to access another company’s data, test our security without permission, or overload the service.
• Keep your logins private; you are responsible for activity on your account.

6. AI features

Jackie and other AI features can make mistakes. You are responsible for what is said in your name and for checking quotes, prices, schedules and anything important before relying on it. Jackie answers from the information you give her; keep it accurate.

7. Other services

SMPL connects to services like Google, QuickBooks, Stripe, Twilio and Facebook. Your use of those services is under their own terms, and we are not responsible for them.

8. Availability and support

We work hard to keep SMPL running and fast, and we back up data daily, but we can’t promise it will never be interrupted. We provide support by email and through the SMPL Academy.

9. Liability

To the extent the law allows, SMPL is provided "as is", and our total responsibility for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. We are not responsible for lost profits or indirect losses.

10. Ending the agreement

You can cancel any time. We may suspend or close an account that breaks these terms or doesn’t pay, after giving notice where reasonable.

11. Changes, law and contact

We may update these terms; we will give at least 30 days’ notice of important changes. These terms are governed by the laws of Alberta, Canada.
